PORTY POWER CUP PARTICIPATION AGREEMENT
1. PARTIES AND SUBJECT
This Participation Agreement (“Agreement”) is entered into between the users (“Participant”) of the Porty Mobile Application (“Porty”) and PORTY SMART TECH TEKNOLOJİ A.Ş. (“Company”), which provides Porty services. This Agreement sets forth the terms and conditions of participation in the Porty Power Cup reward system, the rights and obligations of the Participant, and the responsibilities of the parties.
2. PARTICIPATION CONDITIONS
2.1. Participation in the Porty Power Cup is free for all users who are at least 18 years old, have downloaded the Porty application, registered as a member, and accepted this Agreement.
2.2. Participants can earn points by completing the tasks listed on the Porty Power Cup page.
2.3. Earned points are used to determine rankings for rewards and cannot be transferred, assigned, or converted into cash.
2.4. If the Participant violates system rules, engages in fraudulent activities, or is found to be abusing the system, the Company reserves the right to remove the relevant Participant from the system, cancel their earned points and rewards.3. POINTS AND DETERMINATION OF WINNERS
3.1. At the end of each month, the top 200 users with the highest points will be eligible to receive special rewards displayed in the Porty Power Cup section.
3.2. The winners will be announced at the end of each month through the Porty application and will be notified via in-app notifications.
3.3. Each Participant can only win one reward under the Porty Power Cup.
3.4. Points earned within the Porty Power Cup are valid for 30 days from the date they are obtained. Expired points are automatically deleted. Points cannot be transferred, assigned, or converted into cash.4. REWARD DELIVERY AND RESPONSIBILITIES
4.1. Earned rewards will be delivered in accordance with the reward schedule determined by the Company.
4.2. Rewards cannot be transferred or converted into cash.
4.3. The Participant agrees to provide accurate and complete information required for reward delivery.
4.4. The Company reserves the right to provide an equivalent reward in cases where the original reward is out of stock or unavailable.
4.5. The Company assumes no responsibility or commitment regarding the usability, quality, suitability, warranty, or technical support of physical rewards. All such matters are the responsibility of the manufacturer. The Participant agrees to directly contact the manufacturer for warranty and service requests after receiving the reward.5. DATA PROTECTION (KVKK) AND PRIVACY
5.1. The personal data of Participants are processed in accordance with the Personal Data Protection Law No. 6698 (KVKK) and related regulations.
5.2. Participants can access detailed information about the processing of their personal data through the KVKK Information Notice available in the Porty application.
5.3. Participants can submit requests and inquiries regarding their address and other personal data via the “Contact Us” section within the application.6. TAX OBLIGATIONS
6.1. The Participant who wins a reward is responsible for fulfilling any tax obligations arising from the reward in accordance with applicable regulations. The Company holds no responsibility for determining whether the rewards are subject to taxation or for handling tax payments.
7. TERMINATION CONDITIONS
7.1. If the Company determines that the Participant has violated the terms of this Agreement, engaged in fraud, abuse, fraudulent transactions, or any actions disrupting the system's operation, the Company reserves the right to suspend or remove the Participant's account, cancel their points, void their earned rewards, and unilaterally terminate this Agreement without compensation.
7.2. The Participant may terminate this Agreement at any time by sending a written notice to [email protected] via email. If the Participant terminates the Agreement, their existing points will be deleted, and any earned rewards will be voided.8. FORCE MAJEURE
8.1. Events that occur beyond the reasonable control of the parties and are unforeseeable (such as earthquakes, fires, floods, pandemics, wars, legal regulations, infrastructure failures, etc.) shall be considered force majeure events. In the event of force majeure, the Participant cannot claim any rights or compensation due to the Company's inability to fulfill its obligations.
9. EVIDENCE AGREEMENT
9.1. The parties acknowledge and declare that in the event of any disputes arising from this Agreement, the Company's electronic records, system logs, commercial books, and other digital data shall constitute conclusive and exclusive evidence and that this clause constitutes an evidence agreement within the meaning of Article 193 of the Code of Civil Procedure.
10. NOTIFICATIONS AND COMMUNICATIONS
10.1. The Company may notify the Participant through in-app announcements, email, SMS, or other communication channels provided by the Participant. The Participant is responsible for keeping their contact information up to date. If the provided email address or phone number is invalid, notifications will still be considered valid.
11. AMENDMENTS TO THE AGREEMENT
11.1. Porty reserves the right to update or modify the Porty Power Cup terms at any time. Updates will be communicated to users via in-app notifications. Users are deemed to have accepted the new terms as long as they continue using the system without objection. The Company also reserves the right to terminate the Porty Power Cup at any time.
12. GOVERNING LAW AND JURISDICTION
12.1. This Agreement and its annexes shall be governed by Turkish law and evaluated together with the User Agreement. The parties agree that Istanbul Central Courts and Execution Offices shall have jurisdiction over any disputes arising from this Agreement.
By electronically accepting this Agreement, the Participant acknowledges that they accept all the terms and conditions and agree to participate in the Porty Power Cup under these conditions.
